PROPERTY REGULATIONS AND GUEST OBLIGATIONS
Rules and conditions for a safe and respectful stay
Property Regulations and Guest Obligations
These regulations govern the main conditions for using the properties managed by Ava Home by Daniel Gaioni and the obligations that guests are required to respect during their stay.
The regulations constitute an integral part of the stay conditions and, where applicable, the relevant short-term lease agreement.
1. Compliance with the Law and Prohibition of Illegal Activities
The guest agrees to use the property exclusively for lawful purposes and in compliance with current legislation.
It is forbidden to use the property for illegal or criminal activities, or anything otherwise contrary to the law, public order, or the residential purpose of the accommodation.
2. Prohibition of Prostitution and Related Activities
It is expressly forbidden to use the property for prostitution, aiding or abetting prostitution, paid encounters, organized sexual activities for economic purposes, or other similar illegal activities.
Ava Home is not required to, nor is it physically able to, know in advance the personal or professional activities carried out by guests.
The guest therefore declares, under their own responsibility, that the property will not be used for illegal activities or those incompatible with its residential purpose.
In the presence of concrete elements that reasonably suggest the commission of illegal activities, Ava Home may adopt measures permitted by law and, where necessary, inform the competent authorities.
3. Respect for Condominium Rules and Quiet Hours
The guest is required to respect any applicable condominium regulations, common areas, other residents, neighbors, and the normal rules of civil coexistence.
Shouting, excessive noise, loud music, and behavior that may cause a disturbance to other occupants of the building or the neighborhood are prohibited, particularly during rest hours.
4. Parties, Events, and Gatherings
Parties, events, receptions, or gatherings are not permitted inside the property without prior authorization from Ava Home.
The property must be used in compliance with the maximum number of occupants provided for by the booking and applicable regulations.
5. Persons Present in the Property
Persons other than those indicated in the booking and regularly registered are not permitted to stay overnight in the property.
Any changes regarding guests must be communicated to Ava Home in advance and may only be authorized in compliance with the structure’s capacity and current regulations.
6. Guest Documents
All guests are required to provide the data and valid identity documents necessary for the fulfillments required by current legislation.
Failure to provide the mandatory data may result in the inability to complete the procedures necessary to access the property.
7. Veracity of Information
The guest declares that the data and documents communicated to Ava Home are correct, truthful, valid, and up to date.
The intentional use of false, altered documents or those belonging to different subjects constitutes a serious violation of the stay conditions and may be reported to the competent authorities.
8. Responsibility of the Booking Holder
The person making the booking is required to communicate the conditions contained in these regulations to the other participants.
If they provide Ava Home with personal data relating to other guests, they declare that they are authorized to communicate them as indicated in the Privacy Policy.
9. Correct Use of the Property
The guest is required to use the property, furnishings, systems, appliances, and related equipment with diligence and according to their normal intended use.
It is forbidden to use systems or equipment in an improper, dangerous, or manifestly negligent manner.
The guest is required to promptly report any faults, anomalies, or damage found during the stay.
Liability for Damages
The guest is liable for damages directly attributable to their own willful or negligent conduct and for those caused by persons for whom they are responsible during the stay, within the limits provided by current legislation.
In the presence of damage, Ava Home may request the documentation necessary for its verification and quantification, including photographs, estimates, invoices, or other relevant documentation.
Any claims for compensation must be proportionate to the damage actually suffered, taking into account, where relevant, the condition and ordinary wear and tear of the item.
11. Security Deposit
When provided for in the booking conditions, a security deposit of €300.00 may be requested as a guarantee for any damage attributable to the guest occurring during the stay.
The security deposit does not constitute an additional fee for the stay.
In the absence of damage, sums due, or motivated disputes, the deposit is returned or released according to the methods indicated during the procedure and in any case within the term communicated to the guest starting from check-out.
Should damage attributable to the guest be found, Ava Home may use, within the limits permitted by law, all or part of the security deposit to compensate for the sums actually due, providing the guest with adequate indication of the dispute.
If the assessed damage is higher than the security deposit, Ava Home’s right to request compensation for any greater damage in the manner provided by law remains unaffected.
12. Alternative Option to the Security Deposit – Waiver of Recourse for Damages up to €300.00
If this possibility is provided for the specific booking, the guest may choose, as an alternative to paying the €300.00 security deposit, the payment of a non-refundable contribution of €30.00.
Payment of the €30.00 contribution entails a specific modification of the contractual conditions relating to liability for damages.
By accepting this option, the property owner expressly waives the right to exercise recourse actions or claims for compensation against the guest for accidental damage directly attributable to the guest occurring during the stay, up to a maximum total amount of €300.00.
Therefore, if the total amount of assessed damage is equal to or less than €300.00, no further amount will be requested from the guest for damages falling within the conditions of this option.
If, however, the total amount of assessed damage is greater than €300.00, the waiver of recourse operates only for the first €300.00 and the guest will remain responsible exclusively for the amount exceeding this threshold.
By way of example, if damage of €450.00 is assessed, the property owner will waive recourse for €300.00 and may request from the guest exclusively the remaining sum of €150.00.
This waiver of recourse applies exclusively to accidental damage occurring during the stay and does not apply, unless otherwise expressly indicated, to damage resulting from willful, intentional, or fraudulent behavior, or from use of the property manifestly contrary to the stay conditions.
The €30.00 contribution constitutes the consideration for the modification of the contractual conditions described above and does not constitute a security deposit or an insurance premium.
The choice of the option is optional and is made by the guest before payment, as an alternative to the security deposit provided for the booking.
13. Smoking Ban
Unless otherwise expressly indicated for the specific property, smoking is prohibited inside the apartment.
If a violation of the ban causes documentable damage or makes extraordinary cleaning or interventions necessary, the related costs actually incurred may be requested from the guest.
14. Pets
Pets are allowed exclusively in properties where this possibility is provided or with prior authorization from Ava Home.
The owner or companion of the animal remains responsible for any damage directly caused by the animal and for compliance with the rules applicable to the structure and common areas.
15. Keys and Access Devices
Keys, badges, remote controls, cards, and other access devices made available to the guest must be kept with care.
In case of loss or damage attributable to the guest, the costs actually necessary for the replacement, duplication, reprogramming, or securing of the accesses may be requested.
16. Internet Connection
Any internet connection provided must be used lawfully.
It is forbidden to use the property’s network to commit crimes, computer violations, illegal downloads, or other activities contrary to current legislation.
17. Guest’s Personal Belongings
The guest is responsible for the custody of their personal belongings.
Ava Home is not liable for the loss or theft of the guest’s personal belongings, except in cases where liability is mandatorily provided for by law or the damage is directly attributable to Ava Home.
18. Check-in and Check-out
Guests are required to respect the check-in and check-out times communicated for the specific booking.
Any requests for early entry or late exit must be authorized in advance.
If failure to respect the check-out time causes actual additional costs or interferes with the preparation of the property for subsequent guests, Ava Home may request reimbursement of the costs consequently incurred, where applicable.
19. Access to the Property in Case of Emergency
Ava Home or authorized persons may access the property when necessary to deal with emergencies, dangerous situations, urgent interventions, or to comply with requests from the competent authorities.
In other cases, access during the stay will take place in compliance with applicable legislation and, where possible, with prior notice to the guest.
20. Reporting to Authorities
In the presence of facts that may constitute a crime, dangerous situations, or other circumstances for which the intervention of the authorities is provided for or justified, Ava Home may make appropriate reports to the Police, Local Police, the condominium administrator, or other competent subjects.
21. Serious Violation of the Regulations
A serious violation of these conditions, the contract, current legislation, or the conditions specifically accepted by the guest may lead to the adoption of measures permitted by law and the contract.
In cases of particular gravity, Ava Home may request the cessation of the disputed conduct and, where the legal requirements are met, the early termination of the stay.
The right to request compensation for damages actually suffered and documentable remains unaffected.
22. Sums Already Paid
In the event of early termination of the stay due to a serious breach attributable to the guest, any right to a refund of the sums already paid will be determined in accordance with the booking conditions, the applicable contract, and the mandatory consumer protection legislation.
Ava Home’s right to request compensation for damages actually suffered in the cases provided for by law remains unaffected.
23. Booking Channel
These regulations apply to stays managed by Ava Home regardless of the channel through which the booking was made, within the limits compatible with the contractual conditions and any mandatory rules applicable to the individual channel.
For bookings made through third-party platforms, including Airbnb, Booking.com, or other intermediaries, the conditions of the relative platform also remain applicable when relevant to the relationship.
24. Creation of the Ava Home Account
As part of the digital management of the booking, a personal Ava Home account associated with the e-mail address provided by the guest may be automatically created.
The account allows access to the Guest Area and services related to the booking.
Following the creation of the account, the guest will receive an e-mail containing the instructions necessary to set their own password independently.
The methods for processing personal data relating to the account are described in the Ava Home Privacy Policy.
25. Acceptance of the Regulations
Before submitting the form, the guest has the opportunity to consult these regulations and the Privacy Policy.
By means of the specific declaration of acceptance and, where provided for, the signing of the form, the guest declares to have read, understood, and accepted the conditions applicable to the stay.
Any conditions requiring specific approval will be submitted to the guest separately in the manner provided for by current legislation.
