Personal data processed<\/h2>\n<p>During the booking, registration, and stay management process, Ava Home may collect and process, as necessary:<\/p>\n<ul>\n<li>personal identification data;<\/li>\n<li>contact details, such as email address and phone number;<\/li>\n<li>data relating to the booking and the stay;<\/li>\n<li>data relating to other guests included in the booking;<\/li>\n<li>details and, where necessary, images or copies of identity documents;<\/li>\n<li>information necessary for compliance with public security regulations;<\/li>\n<li>information necessary for the preparation and management of the short-term lease agreement;<\/li>\n<li>data relating to payments, amounts due, tourist tax, security deposits, and other economic conditions relating to the stay;<\/li>\n<li>data relating to the personal Ava Home account;<\/li>\n<li>any further information necessary for the correct management of the booking and for compliance with current regulations.<\/li>\n<\/ul>\n<p>Ava Home applies the principle of data minimization and processes only information that is adequate, relevant, and necessary in relation to the purposes pursued.<\/p>\n<h2>3. Data collection methods<\/h2>\n<p>Data may be collected:<\/p>\n<ul>\n<li>through the Ava Home website;<\/li>\n<li>via the form available at <strong><a href=\"https:\/\/www.avahome.it\/en\/bookings\/\">https:\/\/avahome.it\/prenotazioni<\/a><\/strong>;<\/li>\n<li>during the booking procedure;<\/li>\n<li>through the Guest Area;<\/li>\n<li>via email, telephone communications, or messaging services;<\/li>\n<li>through booking platforms, portals, agencies, or other intermediaries used by the guest;<\/li>\n<li>through management systems and IT tools used by Ava Home for booking management.<\/li>\n<\/ul>\n<p>Through the dedicated booking form, the guest can enter their own personal data and those of other participants in the stay and transmit the documentation necessary for legal compliance.<\/p>\n<h2>4. Booking management and short-term lease agreement<\/h2>\n<p>The data collected may be used to prepare, finalize, execute, and store the contract relating to the stay or the short-term lease agreement, where applicable.<\/p>\n<p>The guest acknowledges that the data provided may be used by Ava Home to:<\/p>\n<ul>\n<li>identify the parties;<\/li>\n<li>associate the guest with the relevant booking;<\/li>\n<li>prepare and manage the contract;<\/li>\n<li>manage check-in and check-out;<\/li>\n<li>provide the information necessary for access to the property;<\/li>\n<li>fulfill administrative, fiscal, and legal obligations;<\/li>\n<li>manage any disputes, damages, or requests relating to the stay.<\/li>\n<\/ul>\n<h2>5. Automatic creation of the Ava Home account<\/h2>\n<p>As part of the booking management and digital services linked to the stay, Ava Home may automatically create a <strong>personal Ava Home account<\/strong> associated with the email address provided by the guest.<\/p>\n<p>The account is intended to allow the guest, depending on the services available, to:<\/p>\n<ul>\n<li>view and manage their bookings;<\/li>\n<li>consult current and past stays;<\/li>\n<li>access information relating to the booked property;<\/li>\n<li>fill in or consult forms linked to the stay;<\/li>\n<li>view information relating to payments;<\/li>\n<li>access digital services made available by Ava Home.<\/li>\n<\/ul>\n<p>Following the creation of the account, the guest may receive a communication at the email address provided containing a link through which they can independently set their password.<\/p>\n<p>Ava Home does not send or store the user&#8217;s password in a readable form.<\/p>\n<p>The creation and management of the account take place as part of the execution of the services requested by the guest and the management of the contractual relationship.<\/p>\n<h2>6. Purposes of processing<\/h2>\n<p>Personal data may be processed for the following purposes:<\/p>\n<ul>\n<li>management of the request and the booking;<\/li>\n<li>identification of guests;<\/li>\n<li>management of the stay;<\/li>\n<li>preparation and execution of the contract;<\/li>\n<li>creation and management of the personal Ava Home account;<\/li>\n<li>management of the Guest Area;<\/li>\n<li>service communications relating to the booking;<\/li>\n<li>management of check-in and check-out;<\/li>\n<li>compliance relating to the tourist tax;<\/li>\n<li>management of payments, security deposits, and sums linked to the stay;<\/li>\n<li>fiscal, accounting, and administrative compliance;<\/li>\n<li>mandatory communications to the competent authorities;<\/li>\n<li>prevention of abuse, fraud, and illicit use of the properties;<\/li>\n<li>establishment, exercise, or defense of a right in judicial or extrajudicial proceedings;<\/li>\n<li>management of any disputes, damages, or claims for compensation.<\/li>\n<\/ul>\n<p>Any processing for further purposes, such as promotional communications or marketing activities, will only be carried out when a suitable legal basis exists and, where required, subject to the specific consent of the data subject.<\/p>\n<h2>7. Communication of data to competent authorities<\/h2>\n<p>Guest data may be communicated to the competent authorities and bodies in the cases provided for by law, including, where applicable:<\/p>\n<ul>\n<li>Police Headquarters (Questura) and Law Enforcement agencies;<\/li>\n<li>the Alloggiati Web system;<\/li>\n<li>Municipalities and bodies competent for compliance relating to the tourist tax;<\/li>\n<li>Revenue Agency (Agenzia delle Entrate);<\/li>\n<li>judicial authorities;<\/li>\n<li>other public bodies or institutional subjects to which communication is mandatory.<\/li>\n<\/ul>\n<p>Such communications are carried out exclusively within the limits and according to the procedures provided for by current legislation.<\/p>\n<h2>8. Legal basis for processing<\/h2>\n<p>Depending on the specific activity carried out, the processing of personal data may be based on:<\/p>\n<ul>\n<li>execution of pre-contractual measures requested by the data subject;<\/li>\n<li>execution of the contract or services requested by the guest;<\/li>\n<li>fulfillment of legal obligations to which the Controller is subject;<\/li>\n<li>legitimate interest of the Controller, where applicable and in compliance with the fundamental rights and freedoms of the data subject, in particular for security needs, prevention of abuse, and protection of their rights;<\/li>\n<li>consent of the data subject, in cases where the legislation expressly requires its acquisition.<\/li>\n<\/ul>\n<p>When processing is necessary for the execution of the contract or to fulfill a legal obligation, the guest&#8217;s consent does not constitute the legal basis for the processing.<\/p>\n<h2>9. Mandatory nature of data provision<\/h2>\n<p>The provision of data marked as necessary is essential to allow Ava Home to correctly manage the booking, identify guests, fulfill the obligations provided for by the regulations, and provide the requested services.<\/p>\n<p>Failure to provide mandatory data or documentation may result in the impossibility of completing the necessary procedures and, in cases provided for by law, the impossibility of allowing access to the property.<\/p>\n<h2>10. Payment data<\/h2>\n<p>Online payments may be managed through external payment service providers, including <strong>Stripe<\/strong>, according to the conditions and privacy policies applicable to the respective services.<\/p>\n<p>Ava Home may receive and store information relating to the status and outcome of the transaction, the amount, the date, the payment identifier, and the associated booking.<\/p>\n<p>Except as may be necessary for specific features offered by the payment provider, Ava Home does not directly acquire the full details of the payment card used by the guest.<\/p>\n<h2>11. Security deposit and damage management<\/h2>\n<p>Where provided for by the booking conditions, Ava Home may process data relating to the security deposit, the relative payment or refund operations, as well as any disputes concerning damage caused to the property, furnishings, or equipment during the stay.<\/p>\n<p>In the event of a dispute, photographs, technical documentation, quotes, invoices, communications with the guest, and any other information reasonably necessary to verify the incident and protect the rights of the parties may also be processed.<\/p>\n<h2>12. Storage of data and documents<\/h2>\n<p>Personal data are stored for the period necessary to pursue the purposes for which they were collected and subsequently for the periods required by applicable legislation or necessary for the protection of the Controller&#8217;s rights.<\/p>\n<p>Administrative, fiscal, accounting, and contractual data may be stored for the period provided for by current legislation, generally up to <strong>10 years<\/strong>, unless longer terms arise from litigation or specific regulatory obligations.<\/p>\n<p>Any images or copies of identity documents collected are stored exclusively for the period necessary to carry out the fulfillments for which they were requested and subsequently deleted or made inaccessible, unless a further storage period is provided for by law or is necessary for the protection of a right.<\/p>\n<p>Data relating to the Ava Home account are stored for the period of use of the account and subsequently for the time necessary to fulfill applicable obligations and manage any contractual relationships still pending.<\/p>\n<h2>13. Processing methods and security<\/h2>\n<p>Processing is carried out using IT, digital and, when necessary, paper tools, adopting technical and organizational measures suitable to guarantee a level of security proportionate to the risk.<\/p>\n<p>Ava Home adopts measures aimed at reducing the risk of loss, unauthorized access, disclosure, modification, or illicit use of personal data.<\/p>\n<h2>14. Communication of data to third parties<\/h2>\n<p>Within the limits strictly necessary for the purposes indicated in this policy, personal data may be communicated to subjects such as:<\/p>\n<ul>\n<li>fiscal, administrative, and legal consultants;<\/li>\n<li>IT service providers;<\/li>\n<li>hosting providers;<\/li>\n<li>management systems and software used for booking management;<\/li>\n<li>payment service providers;<\/li>\n<li>booking platforms;<\/li>\n<li>subjects in charge of the operational management of the properties;<\/li>\n<li>collaborators and authorized personnel;<\/li>\n<li>providers of services necessary for the correct execution of the stay;<\/li>\n<li>public authorities and bodies in the cases provided for by law.<\/li>\n<\/ul>\n<p>These subjects will process the data as data processors, authorized persons, or independent controllers, depending on the role actually held.<\/p>\n<h2>15. Any transfers of data outside the European Economic Area<\/h2>\n<p>Some technological providers used by Ava Home may also process data outside the European Economic Area.<\/p>\n<p>Should this occur, the transfer will be carried out in compliance with the conditions provided for by the GDPR, through adequacy decisions, standard contractual clauses, or other instruments recognized by current legislation.<\/p>\n<p>Further information can be requested from the Data Controller.<\/p>\n<h2>16. Guest responsibility and data of other participants<\/h2>\n<p>The guest declares that the data provided are correct, truthful, and up to date.<\/p>\n<p>If the person making the booking provides personal data relating to other participants in the stay, they declare that they are authorized to communicate them to Ava Home and undertake to inform these subjects of the data processing carried out as part of the booking.<\/p>\n<h2>17. Rights of the data subject<\/h2>\n<p>In the cases and within the limits provided for by articles 15 et seq. of the GDPR, the data subject may exercise their rights, including:<\/p>\n<ul>\n<li>obtaining confirmation of the existence or otherwise of personal data concerning them;<\/li>\n<li>obtaining access to their data;<\/li>\n<li>requesting the rectification of inaccurate data;<\/li>\n<li>requesting the erasure of data in the cases provided for by the regulations;<\/li>\n<li>requesting the restriction of processing;<\/li>\n<li>objecting to the processing in the cases provided for;<\/li>\n<li>requesting data portability, when applicable;<\/li>\n<li>withdrawing consent at any time when the processing is based on consent, without prejudice to the lawfulness of the processing carried out before the withdrawal.<\/li>\n<\/ul>\n<p>Requests can be sent to <strong><a href=\"mailto:info@avahome.it\">info@avahome.it<\/a><\/strong>.<\/p>\n<p>The data subject also has the right to lodge a complaint with the Data Protection Authority (<strong>Garante per la protezione dei dati personali<\/strong>) if they believe that the processing of their data takes place in violation of current legislation.<\/p>\n<h2>18. Review of the policy<\/h2>\n<p>Before sending personal data via the online forms, the guest is put in a position to review this Privacy Policy.<\/p>\n<p>By submitting the form, the guest confirms that they have received and reviewed the information relating to the processing of personal data.<\/p>\n<p>Any consents requested for optional processing distinct from booking management will be collected separately through specific options.<\/p>\n<h2>19.
